Welcome to KiraClubs (the "Platform"). These Terms of Service ("Terms" or "Agreement") govern your access to and use of the KiraClubs website, mobile applications, API services, and associated systems (collectively, the "Service"). By registering an account, downloading our mobile app, or using any feature, you represent and warrant that you have read, understood, and agreed to be bound by this Agreement.
1. ELIGIBILITY AND AGE RESTRICTION (STRICTLY 18+)
The Service is strictly intended for individuals who are at least eighteen (18) years of age or older. Any access, registration, or use of the Service by anyone under 18 is unauthorized, unlicensed, and in violation of these Terms. By creating an account, you represent and warrant that you are of legal age (18+) and have the full capacity to enter into this legally binding agreement. We reserve the right to demand proof of age at any time and to terminate accounts immediately if we suspect a user is under the age of 18.
2. ACCOUNT REGISTRATION, SECURITY, AND VERIFICATION
2.1. Registration: To access features such as direct messaging, video calls, and voice rooms, you must register an account using a valid email address, phone number, or third-party OAuth provider (such as Google, Apple, or TikTok). You agree to provide accurate, current, and complete information.
2.2. Account Security: You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use or security breach.
2.3. Selfie Verification: To ensure the safety of our community, prevent fraudulent activity, and comply with safety policies, users (especially those requesting withdrawals or broadcasting in public rooms) may be required to upload a real-time verification selfie. This photo is checked against your profile photos to verify your identity. Accounts with incorrect or deceptive profile representations may be suspended or deleted.
3. VIRTUAL COIN (JETON) WALLET AND FINANCIAL SYSTEM
3.1. Jeton Purchases: KiraClubs provides a virtual credit system. Users may purchase virtual coins ("Jetons") through licensed third-party payment gateways (e.g., PayTR) or manually via bank transfer/crypto deposit notifications. Jetons have no real-world monetary value, do not earn interest, and are used solely to access platform features, send virtual gifts to other users/broadcasters, or unlock premium features.
3.2. No-Refund Policy: All purchases of Jetons are final, non-refundable, and non-transferable. You acknowledge that Jetons cannot be redeemed for real cash or currency from the Platform unless you qualify under the withdrawal policy for content creators/broadcasters.
3.3. Broadcaster Earnings and Withdrawals: Verified users and broadcasters who receive virtual gifts from other users accumulate virtual earnings in their platform wallet. These earnings can be converted into real-world currency and withdrawn via approved methods (such as local bank transfer/IBAN or USDT TRC20 crypto transfer) subject to: (a) meeting the minimum withdrawal threshold, (b) successful completion of identity verification/selfie checks, and (c) anti-fraud and anti-money laundering (AML) audits.
3.4. AML and Transaction Review: In compliance with international anti-money laundering policies, KiraClubs reviews all transaction logs. We reserve the right to freeze wallet balances, withhold payouts, or terminate accounts if fraudulent deposits, chargebacks, or suspicious activities are detected.
4. USER GENERATED CONTENT (UGC) AND CODE OF CONDUCT
4.1. Ownership of Content: You retain ownership of any text, images, voice messages, or streams you post ("User Generated Content" or "UGC"). However, you grant KiraClubs a worldwide, royalty-free, perpetual, transferable license to host, display, reproduce, and distribute your UGC to operate and promote the Service.
4.2. Prohibited Content: You are strictly prohibited from posting, streaming, or transmitting content that:
- Is sexually explicit, pornographic, or depicts nudity or sexual solicitation.
- Promotes prostitution, escort services, or human trafficking.
- Contains hate speech, racial slurs, defamation, harassment, threats, or incites violence.
- Infringes on the intellectual property, copyright, or privacy rights of third parties.
- Promotes illegal drugs, weapons, or gambling activities.
5. INTELLECTUAL PROPERTY RIGHTS
All rights, titles, and interests in the KiraClubs Service, including software, design, user interface, brand name, logo, and proprietary source code, are owned exclusively by KiraClubs. You are granted a limited, personal, non-exclusive, non-transferable, and revocable license to use our mobile application and website for social purposes in accordance with these Terms.
6. LIMITATION OF LIABILITY AND WARRANTY DISCLAIMER
6.1. No Warranties: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, regarding the availability, security, or accuracy of the Service.
6.2. Limitation of Liability: To the maximum extent permitted by applicable law, KiraClubs, its affiliates, directors, or employees shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use of the Service, including but not limited to financial losses, loss of data, or interactions with other users.
7. SUSPENSION AND TERMINATION
We reserve the right to terminate, suspend, or restrict your access to your account and the Service at our sole discretion, without notice or liability, for any violation of these Terms, non-payment, fraud, or to protect the safety of the platform community.
8. DISPUTE RESOLUTION AND GOVERNING LAW
This Agreement and any dispute arising out of or related to it shall be governed by, construed, and enforced in accordance with the laws of the Republic of Turkey. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts and execution offices of Istanbul, Turkey.
